The lawsuit was filed under a federal sex trafficking law, based on a claim that Weinstein traveled overseas to use fraud and coercion to obtain a commercial sex act, and also named his brother and their company for knowing about his behavior and profiting from it. TMZ reports that Harvey Weinstein and Bob Weinstein are both being sued by a woman who said that Harvey sexually assaulted her in Cannes, France.
"Kadian has suffered severe injuries and emotional distress, pain and suffering, mental anguish, inconvenience, loss of capacity for the enjoyment of life, inability to lead a normal life, shame and humiliation", lawyer Stuart Mermelstein writes.
The lawsuit also claims that Bob Weinstein helped Harvey do what he did by either knowing about or completely ignoring Harvey's habit of traveling to other countries "to entice or recruit or solicit young female actors with the promise of roles in upcoming TWC projects ... knowing that he would then use fraud, force or coercion to engage in sex acts with these actors".
Weinstein then pulled down Noble's shirt and forced his leg between her legs, and rubbed her genitals and began masturbating, the suit said.
The actress is seeking unspecified damages, accusing Weinstein of being able "to force or coerce" her into sexual activity by promising to wield influence in the film industry - and that it was a violation of sex trafficking statute.
Harvey Weinstein denies any allegations of non-consensual sex.
What followed was Weinstein allegedly calling a TWC producer and after putting Noble on the line, "The TWC producer told [Noble] that she needed to be "a good girl and do whatever [Weinstein] wished, ' and if she did, then 'they would work" with her further".
At that point, Weinstein "pulled Kadian closer and groped her breasts" according to the suit, despite the plaintiff's protests.
Weinstein "blocked her exit" next according to court papers and 'pulled down Kadian's shirt, revealing her breasts, and unbuckled his trousers and belt'. The Weinstein Company is also named as a defendant.

The Weinstein Company did not reply to a request for comment from HuffPost. "Mr Weinstein has further confirmed that there were never any acts of retaliation against any women for refusing his advances".
